The police on Friday failed to present its defence at the ongoing hearing of the Independent Investigative Panel on human rights violations by the disbanded Special Anti-Robbery Squad (SARS) and other as it is yet to make contact with respondents listed in the alleged extra judicial killing of one Sifullahi Sani Musa.
The lead counsel to the police, James Idachaba, told the panel that the police is trying to unravel the circumstances that led to the death of Saifullahi and why the police in Kano allegedly appeased the family with food stuff and money.
Idachaba explained that they need to investigate if the death was due to negligence on the part of the police or the police acted outside the ambit of the law before they can put up their defence.
It will be recalled that Hassan Sani Musa, brother to the victim, in his testimony before the panel alleged that his brother was tortured to death by the police. And the police compensated the family with food items and money.
The case has been adjourned to March 23, 2022, for defense.
Similarly, the panel ordered the Counsel to petitioner, E. K. Okoko , to present the certified true copies of the court proceedings from court 4 G.R.A. in Ikpan, Effuru in Delta state in a suit filed against the police in the alleged murder of Collins Onaodowan and Owen Onadowan or the case will be foreclosed against his petitioner and the police would proceed to present its defence.
The panel gave this charge through Aikpokpo-Martins , 1st Vice President NBA, who was representing the Chairman, Justice Suleiman Galadima, to Okoko, who failed to present the CTC of court proceedings following orders made at the last hearing.
It will be recalled that Otomerhe Onaodowan at the last sitting,in her testimony, alleged that her two sons were allegedly extra judcially killed by the police in Delta state and she filed a suit against the police in Court 4 G.R.A in Ikpan,Effuru.
However, the matter has been adjourned to March 23, 2022, for the production of the CTC of court proceedings.
In another development, the panel struck out a petition of alleged violation of right to human dignity, right to personal liberty and right to property by one Muhammed Umoru.
The panel struck out the case due to lack of diligent prosecution. The complainant failed to appear before the panel despite several adjournments.
